## The federal rule for children under 13

The regulation is short. Under [33 CFR 175.15](https://www.law.cornell.edu/cfr/text/33/175.15), no one may operate a recreational vessel underway with a child under 13 aboard unless the child is "wearing an appropriate PFD approved by the Coast Guard" or is "below decks or in an enclosed cabin." ## Weight ranges: read the label, not the age

The Coast Guard's [life jacket wear page](https://uscgboating.org/recreational-boaters/life-jacket-wear-wearing-your-life-jacket.php) defines the new label categories by weight: infant is 33 lb or less, child is over 33 up to 55 lb, youth is over 55 up to 88 lb, and adult is over 88 lb. ## Crotch straps and head support

For toddlers, two features matter most. Adult jackets are not a stand-in. The Coast Guard brochure says life jackets designed for adults "will not work for children," and it marks every inflatable style "not for children under 16." ## The fit test

The Coast Guard brochure gives a five-step test. Check the label for the child's size and weight. Fasten the jacket. Have the child hold both arms straight up. Grasp the tops of the arm openings and gently pull up. There should be no excess room above the openings, and the jacket must not ride up over the chin or face.

It adds one more step: for the best fit, try the life jacket in shallow water under safe and supervised conditions. The Coast Guard's wear page says a foam jacket that fits "will not allow the lifejacket or buoyancy aid to rise above the wearer's chin or ears," and that you should try it in the water to make sure the airway is clear.


## Why wear matters

The Coast Guard's [2024 recreational boating statistics](https://www.uscgboating.org/library/accident-statistics/Recreational-Boating-Statistics-2024.pdf) report 556 deaths. Where the cause was known, 76% of victims drowned, and where life jacket use was known, 87% were not wearing one. The same report says 4 of every 5 boaters who drowned were on vessels under 21 feet.

**Key point:** water wings and pool floats are not life jackets. Safe Kids says swimming aids and water toys "do not prevent drowning," so a child on a boat needs a Coast Guard approved jacket in the right weight band.
